WILLIAMS MOUNTAIN – Boone County Sheriff’s Deputies made an arrest overnight in the attempted murder of a local man.
Dale Edward Lowther, Jr., 33, of Van, was arrested and charged with attempted murder, according to Boone County Chief Deputy Chad Barker.
The victim, Gary Hubbard, also from the Van area, was shot multiple times in the back with a .22 caliber firearm around 9:30 p.m. Thursday night. Police say he was driving along County Route 5 in the Williams Mountain area.
Officers originally responded to reports of the shooting as well as a man who had been run over by a vehicle.
“Lowther claimed he had been struck multiple times by a vehicle driven by Hubbard prior to the shooting,” Barker said. “Deputies were able to determine the reports of Lowther being struck by the vehicle to be untrue.”
Barker said that investigators believe the false report was either an attempt to justify the shooting or to evade capture by law enforcement.
“The number of rounds fired appears to be approximately 10,” Barker added.
Lowther was arraigned Friday morning in front of Boone County Magistrate Porter Snodgrass and bail was set at $200,000 property only.
Attempted murder carries a possible sentence of 3 to 15 years in prison.
Hubbard is still hospitalized in critical condition with life threatening injuries, according to Barker.
