Gay, WV 25637 has submitted a application to the Department of Environmental Protection (DEP) 1101 George Kostas Dr. Logan WV 25601 for an Amendment to Article 3 permit number S-5005-02 for the surface disturbance of approximately 136.46 additional acres for a total bonded area of 513.60 acres in order to operate a surface mine in the Kittanning, Upper and Lower 5-Block, Upper and Lower

Stockton, and Coalburg and all splits of each of these seams of coal. The proposed operation is discharging into Garland Fork and Abe Burgess Fork of Garland Fork of Spruce Fork of the Little Coal River of the Coal River of the Kanawha River and Rum Creek of the Guyandotte River of the Ohio River and is located 2.6 miles Northwest of Amherstdale, WV in Logan District(s) of Logan County, Longitude 81° 49' 33" and Latitude 37° 39' 10" (Coordinates from USGS Topographic Map).

Written comments and/or requests for an informal conference of the surface mining application shall identify the applicant and application number and will be received by the Permit Supervisor at the DMR office and address above until December 27, 2009, or thirty (30) days from date of final publication. A copy of the application will be available for review until December 27, 2009, or thirty (30) days from date of final publication in the DEP Regional Office located at the address above AND in the Logan County Clerk's Office during normal business hours.
