Scaggs facing multiple charges

West Virginia State Police officers were called to a fight in progress in the road at 1113 Mill Creek Road, where they were told by witnesses the defendant involved in the fight had fled.


Officers clocked the vehicle being driven by the defendant traveling 73 miles per hour in a 45 mile per hour speed zone on Route 10, near Phico.


The officers came up on the vehicle sitting by the road with the door open and nobody inside and were able to locate the driver, Michael David Scaggs Jr., 37, of Chapmanville.


A license check revealed Scaggs had a revoked driver’s license for unpaid citations.


Christopher Lee gave a statement to the officers and said Scaggs was threatening to kill everyone at his residence and would not leave. Lee tried to get Scaggs to leave and they had a physical altercation.


Thurman Lee was there and told the officers Scaggs had threatened to kill everyone and would not leave. Another witness there was James Lee, who told officers the defendant thought his girlfriend was cheating on him, was angry and said he was going to kill him during a telephone call. He further stated when Scaggs arrived at the residence, he refused to leave, said he was going to kill everyone and when Chris Lee confronted him, the two got into a physical altercation.


Scaggs was later arrested and charged with battery, five counts of assault, driving revoked (non-DUI), fleeing on foot and speeding.
